Terms of Service

1. Accounts

You need to be at least 16 years old to create an account, or have the consent of a parent or guardian. Give correct information, keep your password safe and tell us if someone else gets access to your account. You are responsible for what happens on your account. One person may use several profiles within the limits of their plan, but may not create accounts to get around a ban or limit.

2. Your content

You keep all rights to what you upload or write. You give us the non-exclusive, free right to store, show and process it as far as needed to run the Service, for example to display your profile, make thumbnails or deliver files. This right ends when you delete the content or your account, except for copies we must keep by law.

You are responsible for your content and confirm that you have the rights to it. This includes pictures, videos, backgrounds, cursors, fonts and music you upload or link: only use material you made yourself, that is licensed for this use, or that you are otherwise allowed to use. Music you add to your profile player is played publicly to every visitor; make sure you hold the rights for that.

3. Acceptable use

You may not use the Service to:

• host or link to phishing, scams, malware or other illegal content
• impersonate another person, brand or organization
• upload content that infringes someone else's rights, such as copyright or personality rights
• share sexual content involving minors, extremist propaganda, or content glorifying violence
• harass, threaten or dox others
• send spam or get around upload limits, rate limits or other technical restrictions
• inflate views, link clicks, likes or comments artificially, for example with bots, scripts, proxies or bought traffic, or offer such services
• attack, overload or scrape the Service

We may remove content, give warnings, limit features, or suspend or close accounts that break these Terms or the law, including after reports through our report form or our copyright process. For artificial views or clicks we may also reset the statistics and remove the badges earned with them. We consider your legitimate interests, choose the mildest effective step and tell you why, unless the law or safety reasons prevent this. You can object through the contact page.

4. Our content and brand

The name puh.gg, the Puh logo and ghost, the design of the website and dashboard, the badges, emojis, sounds, texts and the software are protected by copyright and trademark law and belong to Puh Network or its licensors. You may use the puh.gg name and logo to link to your profile or to talk about the Service. Any other use, in particular copying the design, the badges or the code, selling items that look official, or giving the impression that you speak for puh.gg, needs our prior written permission.

Templates other users share in the template gallery remain their content; using a template only lets you use the look on your own profile. Ideas and suggestions you send us may be used to improve the Service without any obligation to you.

5. Reporting illegal content

Anyone can tell us about content on puh.gg that they believe is illegal or breaks these Terms, through the report form or by email to [email protected]. Copyright and other rights of third parties follow our copyright policy. A good report names the exact link, explains why the content is illegal, and gives your name and email, unless the report concerns child sexual abuse material, which can be sent anonymously. We review every report carefully and without undue delay, decide in a fair and objective way, and tell the reporter what we decided where we have contact details.

If we remove or restrict your content or account, we tell you which content is affected, what we did, the reason and the rule or law it is based on, and how you can challenge it, unless the law or safety reasons prevent this. Content that endangers someone's life or safety, or that we must report by law, is passed on to the authorities.

6. Complaints and appeals

You can challenge a moderation decision (removed content, a warning, limited features, a suspended or closed account) within six months by email to [email protected] or through a support ticket in our Discord server. A different member of our team who was not involved in the first decision looks at it again and we tell you the result. If we were wrong, we undo the decision. You can also turn to a certified out-of-court dispute settlement body under the EU Digital Services Act or to the courts.

We may suspend, for a reasonable time and after a warning, accounts that often post clearly illegal content, and stop handling reports from people who often send clearly unfounded reports.

7. Free and paid features

The basic Service, including profiles, all free layouts, widgets and the image host with its free limits, is free. Premium, Image Host, Verified, custom badges and Alias Tokens are paid extras. We develop the Service further and may change or replace individual features, as long as the paid extras you bought keep their essential function.

8. Purchases

All prices are final prices in euros and are shown before you pay. All products are one-time purchases; there are no subscriptions. The contract is made when you complete the payment on the payment page. The contract language is English.

Payments are processed by Stripe (card, Apple Pay, Google Pay, SEPA Direct Debit, Klarna and other methods depending on your country) or by NOWPayments (crypto). The product is delivered to Your items in your dashboard as soon as the payment is confirmed; for crypto and some bank methods this can take a few minutes up to a few days.

A product in Your items can be used on your own account, gifted to another user or sent as a gift link. A gift link can be claimed once, by whoever opens it first, and can be taken back until it is claimed. Gifted or claimed products cannot be returned. Products may not be resold for money.

Lifetime products last as long as the Service exists and your account is not closed for breaking these Terms. Custom badges and names must follow these Terms; we may remove a badge with an offensive or misleading name or icon. Verified can also be granted for free to content creators; we may remove it when an account impersonates someone.

Donations are voluntary payments without a claim to any product. They count toward your Donator level together with your purchases.

9. Right of withdrawal

If you are a consumer, you have the following right of withdrawal.

Withdrawal instructions

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (Puh Network, email [email protected]) of your decision to withdraw from this contract by an unequivocal statement, for example an email. You may use the model withdrawal form below, but this is not required. To meet the withdrawal deadline, it is sufficient for you to send your notice before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive your notice. We use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

Early end of the right of withdrawal. For digital products that are not supplied on a physical medium, your right of withdrawal ends as soon as we have begun to deliver the product, if you have expressly agreed that we begin before the end of the withdrawal period and you have confirmed that you know you lose your right of withdrawal once delivery begins. You give this consent and confirmation with the checkbox before paying. Products in the shop are delivered to Your items right after payment.

10. Availability

We work to keep the Service available, but cannot promise uninterrupted operation. Maintenance, updates and events outside our control can cause interruptions. Third-party services that widgets or logins depend on can change or stop at any time.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For slight negligence we are only liable for breach of an obligation that is essential for the contract and on which you may rely (cardinal obligation), limited to the damage that is typical and foreseeable for this kind of contract. Otherwise our liability for slight negligence is excluded. These limits also apply to our staff and agents.

Please keep your own copies of important files; the image host is not a backup service.

12. Ending the contract

You can delete your account at any time under Security. We can end the contract with four weeks' notice, and without notice for an important reason, in particular serious or repeated violations of these Terms. If we end the contract without such a reason, we refund the paid extras on a pro rata basis.

13. Changes to these Terms

We may change these Terms for valid reasons, for example new features or changes in the law. We will tell you about changes by email or in the dashboard at least four weeks before they take effect. If you do not object before then, the changes apply; we will point this out in the notice. If you object, we may end the contract with effect from the date of the change. Changes to the main obligations of the contract need your express consent.

14. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not take away the protection of the mandatory law of the country where you live. If individual provisions are invalid, the rest of these Terms remain valid.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
